Acceptable Use Policy

2.1 Illegal Content

Any content that violates the laws of Kenya, the laws of the country where your content is accessed, or applicable international law. This includes content that infringes on intellectual property rights, violates privacy rights, or constitutes fraud.

2.2 Child Sexual Abuse Material

Absolutely prohibited. Any content that sexually exploits or abuses minors, or that could be used to groom, exploit, or harm children will result in immediate account termination without notice or refund. Such content will be reported to the relevant law enforcement authorities in Kenya and internationally, including the Internet Watch Foundation (IWF) and the Directorate of Criminal Investigations (DCI) Kenya.

2.3 Malware and Malicious Code

Viruses, trojans, worms, ransomware, spyware, adware, keyloggers, rootkits, or any other software designed to damage, disrupt, or gain unauthorised access to systems or data belonging to any person or organisation.

2.4 Phishing and Fraud

Websites, pages, or applications designed to deceive users into providing personal information, login credentials, financial details, or payment information under false pretences. This includes fake login pages, fraudulent e-commerce sites, and social engineering tools.

2.5 Spam and Unsolicited Communications

Content used to generate, send, or facilitate unsolicited bulk email (spam), unsolicited SMS campaigns, or any other form of mass unsolicited communication. Operating open mail relays or using Tayo Host infrastructure as a platform for spam distribution is strictly prohibited.

2.6 Hate Speech and Discriminatory Content

Content that promotes, incites, or glorifies violence or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic. This applies under the Constitution of Kenya 2010 and international human rights standards.

2.7 Defamatory Content

Content that is knowingly false and damaging to the reputation of an identifiable individual or organisation, in violation of Kenyan defamation law.

2.8 Unlicensed Gambling

Online gambling platforms, betting services, or gaming operations that are not licensed under Kenyan law or the applicable law of the jurisdiction in which they operate.

2.9 Copyright-Infringing Content

Content that reproduces, distributes, or makes available copyrighted material — including software, music, films, books, images, or other works — without the authorisation of the rights holder. Tayo Host will respond to valid copyright infringement complaints submitted under applicable law.

2.10 Content Violating Kenyan Law

Any content prohibited under Kenyan law, including the Computer Misuse and Cybercrimes Act 2018, the Kenya Information and Communications Act (KICA), the Consumer Protection Act 2012, or any other applicable Kenyan statute or regulation.

3.1 Network Attacks

Launching, facilitating, or participating in denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any system, network, or service. Conducting port scans, network probing, vulnerability scans, or attempting to gain unauthorised access to any system — including Tayo Host infrastructure, other clients' accounts, or any third-party network or device.

3.2 Cryptocurrency Mining

Running cryptocurrency mining operations of any kind on Tayo Host shared hosting infrastructure. Mining is prohibited because it consumes disproportionate server resources and degrades service for all clients on shared infrastructure. This prohibition applies regardless of the currency being mined.

3.3 Proxy and VPN Services

Operating open proxy servers, anonymising proxy services, or VPN services that are used to facilitate illegal activity, mask the origin of attacks, circumvent geographic restrictions for unlawful purposes, or conceal the identity of users engaged in prohibited conduct.

3.4 Bulk Email and Spam

Sending unsolicited bulk email from or through Tayo Host infrastructure. Running mailing list operations that have not obtained proper consent from recipients. Using Tayo Host email hosting to send commercial communications to recipients who have not opted in to receive them.

3.5 Resource Abuse on Shared Hosting

Using shared hosting resources in a manner that unreasonably degrades the performance of the shared server environment for other clients. This includes running resource-intensive background processes, scripts that generate excessive CPU or memory usage, bulk file operations, or automated processes that place continuous heavy load on the server. Tayo Host may throttle, restrict, or suspend accounts that engage in resource abuse, and will make reasonable efforts to notify you before doing so.

3.6 Unauthorised Access

Attempting to access any Tayo Host system, account, or data that you are not authorised to access. Attempting to access other clients' accounts, data, or files. Exploiting any vulnerability in Tayo Host infrastructure or software.

3.7 Falsifying Identity or Origin

Forging email headers, IP addresses, or other identifiers to misrepresent the origin of content or communications. Using Tayo Host services to impersonate any person, organisation, or entity.

3.8 Reselling Services

Sublicensing, reselling, or otherwise making Tayo Host hosting services available to third parties as if they were your own hosting product, without prior written authorisation from Tayo Host. Each business or individual requires their own Tayo Host account as described in our Terms of Service.

8.1 Our Right to Act

Tayo Host reserves the right to investigate any suspected violation of this AUP. Where a violation is confirmed or strongly suspected, we may take any of the following actions at our sole discretion, without prior notice where immediate action is necessary to protect our infrastructure or other clients:

• Issue a formal warning to your account
• Remove, disable, or block access to specific content or files
• Suspend your account temporarily while the matter is investigated
• Terminate your account permanently without refund
• Report the violation to the relevant law enforcement authorities in Kenya or internationally
• Cooperate fully with law enforcement investigations involving your account

8.2 Notice Where Possible

Where the nature of the violation allows, Tayo Host will provide you with written notice of the suspected violation and an opportunity to remedy it before taking action. However, certain violations — particularly those involving child exploitation material, active malware distribution, DDoS attacks, or other serious threats — require immediate action and will be handled without prior notice.

8.3 No Liability for Enforcement Actions

Tayo Host is not liable for any loss, damage, or inconvenience resulting from enforcement actions taken in good faith under this AUP. If you believe an enforcement action has been taken in error, contact us at legal@tayohost.com immediately so we can review the matter.
